Book on the Basic Sanitation Regulatory Framework to be launched in São Paulo

On 4/18, the book ”Tratado sobre o Marco Regulatório do Saneamento Básico no Direito Brasileiro” (Treatise on the Basic Sanitation Regulatory Framework in Brazilian Law) will be launched. The work contains 42 articles by specialists in the field, including attorneys, public prosecutors, judges, engineers and representatives of sector institutions and bodies of the Judiciary.

The work is divided into five key themes. The first part discusses the reality of basic sanitation in Brazil, assessing why so little progress has been made in its implementation. The second part covers the historical evolution of sanitation in the country, and the third discusses jurisdiction in the area, that is, who is responsible for providing basic sanitation. The fourth part discusses the duty to provide sanitation services, including the instruments for their operation, such as concessions, public-private partnerships (PPPs) and remuneration and billing systems. The last part addresses issues such as regulation of the sector and how to oversee and control the State’s duty with regard to sanitation.

Giamundo Neto Advogados made two important contributions to this book. Founding partner Giuseppe Giamundo Neto contributed the article “A titularidade dos serviços públicos de saneamento básico” (Ownership of public basic sanitation services). Giuseppe notes that the article aims to analyze the legal aspects of ownership of basic sanitation services “in order to assess, in light of the Federal Supreme Court’s judgment in Direct Action of Unconstitutionality (ADI) No. 1,842/RJ, whether certain municipalities may delegate public water supply and sewage services to third parties”, he says.

Another contribution from the firm came from attorney Luiz Felipe Pinto Lima Graziano, a member of the Sanitation and Ethics and Compliance Committees of ABCE – Brazilian Association of Engineering Consultants. Graziano contributed the article “Saneamento Básico e Governança Interfederativa das Metrópoles” (Basic Sanitation and Inter-Federative Governance of Metropolitan Areas), co-authored with Rafael Roque Garofano and Daniel Almeida Stein. The attorney notes that the Federal Basic Sanitation Law (Law 11,445/07) turned eleven at the beginning of 2018 without universal service being even close in Brazil. ”At the end of the second decade of the 21st century, more than 35 million people still have no access to treated water; less than half of Brazilians have access to sewage collection and only 42.67% of the sewage collected in the country is treated, according to the National Sanitation Information System (2015)”, he explains.

The book launch will take place at OAB-SP headquarters, from 6 p.m.
