Authorities sign new Agreement to set parameters for leniency agreements with the Federal Government

A new Technical Cooperation Agreement (“ACT”) was recently signed between the Office of the Comptroller General (“CGU”), the Office of the Attorney General (“AGU”) and the Federal Prosecution Service (“MPF”), with the aim of improving and expanding cooperation, coordination and integration among the signatory institutions in the negotiation, execution and performance of leniency agreements provided for in the Anti-Corruption Law (Law No. 12,846/2013).

Representing progress in joint and coordinated action among the institutions, the Agreement is part of an effort to promote greater legal certainty and reliability for leniency agreements. It has an initial term of five years and may be extended.

Among other provisions, the new ACT establishes (i.) common objectives for inter-institutional cooperation, (ii.) relevant parameters for standardizing agreement negotiations, (iii.) coordinated action and information sharing among the signatory institutions, (iv.) an action plan to define a common methodology for calculating the amounts associated with the agreement, and (vi.) whistleblower protection mechanisms.
