Provisional Measure No. 786 of 2017

On 07.12.2017, the Federal Government sent MP 786 to the National Congress, dealing with the Federal Government’s participation in supporting the structuring and development of Concession and Public-Private Partnership projects at the state and municipal levels.

The Provisional Measure provides for the Federal Government’s participation in a fund with a limit of BRL 180,000,000.00 (one hundred and eighty million reais), whose sole purpose will be to finance specialized professional technical services.

Provisional Measure No. 752 is converted into Law

Provisional Measure No. 752, which deals with the general guidelines for the extension and re-tendering of partnership contracts for highways, railways and airports, was converted into Law No. 13,448.

The law sets criteria for early extension with the inclusion of new investments that are necessary but were not originally provided for in the concession contracts.

It also provides for the possibility of re-tendering contracts where the concessionaire is unable to ensure the continuity of service provision.
